POLICY REGARDING INTELLECTUAL PROPERTY
Public is committed to protecting the intellectual property rights of all its users. To that effect, this Policy Regarding Intellectual Property (henceforth ‘Policy’) lays down the basic rules you have consented to by your use of the Public Mobile Application. This Policy shall be read as part and parcel of Public’s Terms and Conditions, and in case of any discord between anything else contained in the Terms and Conditions and this Policy, this Policy shall override.
1.Use of Content by Users.
1.1. The Content on the Service, and the trademarks, service marks and logos ("Marks") on the Service, are owned by or licensed to Public, subject to copyright and other intellectual property rights under the law.
1.2. Content is provided to the user AS IS. The User may access Content for her or his own information and personal use solely as intended through the provided functionality of the Public’s services and as permitted under the Terms and Conditions. User shall not download any Content unless a download link is specifically provided by the Public Mobile Application. Users shall not copy, reproduce, make available online or electronically transmit, publish, adapt, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Content for any other purposes without the prior written consent of Public or the respective licensors of the Content. Public and its licensors reserve all rights not expressly granted in and to the service and the Content.
1.3. Users agree not to circumvent, disable or otherwise interfere with security-related features of the service or features that prevent or restrict use or copying of any Content or enforce limitations on use of the Service or the Content therein.
1.4. Users understand that when using the Service, they will be exposed to Content from a variety of sources, and that Public is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such Content. They further understand and acknowledge that they may be exposed to Content that is inaccurate, offensive, indecent, or objectionable, and they agree to waive, and hereby do waive, any legal or equitable rights or remedies users have or may have against Public with respect thereto, and, to the extent permitted by applicable law, agree to indemnify and hold harmless Public, its owners, operators, affiliates, licensors, and licensees to the fullest extent allowed by law regarding all matters related to their use of our services.
2.License And Conduct
2.1. As a Public account holder you may submit Content to the App, including videos, photographs and user comments. Users understand that Public does not guarantee any confidentiality with respect to any Content they submit.
2.2. Users shall be solely responsible for their own Content and the consequences of submitting and publishing their Content on Public. Users affirm, represent, and warrant that they own or have the necessary licenses, rights, consents, and permissions to publish Content they submit; and they license to Public all patent, trademark, trade secret, copyright or other proprietary rights in and to such Content for publication on Public pursuant to this Policy and pursuant to the Terms and Conditions.
2.3. For clarity, while users retain all of their ownership rights in their Content, by submitting Content to Public, they hereby grant Public a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, publish, adapt, make available online or electronically transmit, and perform the Content in connection with the services offered by Public and Public's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the services provided by Public (and derivative works thereof) in any media formats and through any media channels.
3.Removal of Doubts
This Policy is part and parcel of, and should be read together with Public’s Terms and Conditions, Privacy Policy and Content Regulation Policy. Any terms whose definitions may not be clear by reference to this document shall be understood (if so applicable) in accordance with definitions provided under the Terms and Conditions, Privacy Policy and Content Regulation Policy.
